22. Regulations Relating to Registration of Wakf.–(1)
An application for registration of a Wakf shall be
made in duplicate in form No. 1 of the schedule and
registered at the office of the Kerala Wakf Board at
Ernakulam or at the Regional Office at Kozhikode.
(2) The fee for registration of each Wakf shall be
Rs. 50 (Rupees Fifty) for a Wakf having gross annual
income upto Rs.5,000 and shall be Rs.100 for Wakf
having annual income exceeding Rs.5,000.
(3) Every application made under sub section (2) of
section 36 of the Wakf Act, 1995 shall be signed and
verified by the applicant in the manner provided in
the Code of Civil Procedure, 1908 (5 of 1908) for
the signing and verification of pleadings.
23. Suo-moto Registration.–The Board, on
receipt of information that any Wakf is not
registered with Board, may require an Officer of the
Board to conduct a local enquiry and on the report
of the Officer, if the Board, prima facie is of
opinion that it is a Wakf to be registered under the
Act shall issue notice to the person who is
administration the Wakf, to show cause why the said
Wakf should not be registered. The Board shall
consider the objections, if any, and pass
appropriate orders. The order of the Wakf Board
shall be final unless otherwise modified by the
Tribunal. |
